Holder May Crack Down On White Collar Crime
The appointment of Eric Holder as Attorney General is likely to result in more vigorous prosecution of white collar crime under the incoming Obama administration, according to Oxford Analytica.
Aside from his role in the pardoning of fugitive financier Marc Rich, Holder enjoys a strong reputation for public integrity, OxAn says. “This will translate into a toughened prosecutorial focus at the Justice Department in several areas of concern to business — especially antitrust enforcement, corruption, environmental protection and financial fraud.”
Holder’s extensive experience in corruption investigations may lead the DOJ to examine aggressively allegations of fraud that facilitated the subprime crisis.
Business litigation risk can be expected to increase at the federal level as a result of Holder’s more aggressive enforcement priorities, OxAn says. “However, it will also be more uniform and predictable, since state AGs are less likely to pursue independent enforcement agendas.”
